Terms of Service for MarkTube

1. Acceptance of Terms

Welcome to MarkTube (the “Extension”), developed by Sayan Biswas. By installing, accessing, or using the MarkTube Chrome Extension, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not install or use the Extension.

2. License to Use

Subject to your compliance with these Terms, Sayan Biswas grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the Extension for your personal, non-commercial use on a compatible Chrome browser.

3. User Responsibilities and Conduct

You agree to use the Extension only for lawful purposes and in accordance with these Terms. You are solely responsible for:

• Ensuring that your use of the Extension complies with all applicable local, state, national, and international laws and regulations.
• Maintaining the confidentiality of your Google account credentials, which are used to access synchronization features.
• All activities that occur under your Google account in connection with the Extension.
• The content you create, store, and sync using the Extension (bookmarks, notes, categories).

You agree not to:

• Misuse the Extension by attempting to interfere with its proper working, or access it using a method other than the interface and instructions provided.
• Decompile, reverse engineer, disassemble, or otherwise attempt to derive the source code for the Extension.
• Use the Extension for any illegal or unauthorized purpose.
• Remove, obscure, or alter any proprietary rights notices (including copyright and trademark notices) that may be affixed to or contained within the Extension.

4. Google Account and Google Drive

The Extension requires you to log in with your Google account to use its full features, including the synchronization of your bookmark data to your Google Drive.

• By using these features, you authorize the Extension to access your Google account for authentication and to store and retrieve data from a specific application data folder (AppData folder) within your Google Drive, as described in our Privacy Policy.
• The Extension only has access to this specific AppData folder and does not access, modify, or delete other files or folders in your Google Drive.
• Your use of Google services (like Google Account and Google Drive) is subject to Google’s own Terms of Service and Privacy Policies.

5. Intellectual Property

The Extension, including its original content (excluding any data you generate or sync), features, and functionality, are and will remain the exclusive property of Sayan Biswas and its licensors. The Extension is protected by copyright, trademark, and other laws of both [Your Country/Jurisdiction - placeholder] and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Sayan Biswas.

6. Termination

We may terminate or suspend your access to the Extension immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Extension will immediately cease. If you wish to terminate your agreement with these Terms, you can do so by uninstalling the Extension from your browser and, if applicable, revoking its access to your Google Account via your Google Account settings.

7. Disclaimer of Warranties

The Extension is provided on an "AS IS" and "AS AVAILABLE" basis. Your use of the Extension is at your sole risk. The Extension is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

Sayan Biswas does not warrant that a) the Extension will function uninterrupted, securely, or be available at any particular time or location; b) any errors or defects will be corrected; c) the Extension is free of viruses or other harmful components; or d) the results of using the Extension will meet your requirements.

8. Limitation of Liability

In no event shall Sayan Biswas, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Extension; (ii.f) any conduct or content of any third party on the Extension; (iii) any content obtained from the Extension; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect (e.g., by posting on the Extension's web store page or website). What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Extension after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Extension.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of [Your Country/State/Jurisdiction - e.g., India, or the specific state if applicable], without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Extension and supersede and replace any prior agreements we might have between us regarding the Extension.
